NETT MAGAZINE “Win an iPad” COMPETITION
TERMS AND CONDITIONS
- Entry into the NETT MAGAZINE “Win an iPad” competition (the “Competition”) is open to all residents of Australia. The Promoter is Nett Publishing Pty Ltd (ABN: 68 127 464 975) of Level 4, 1-3 Smail Street, Broadway, NSW 2007 (the “Promoter”). Information on how to enter forms part of the terms of entry. Entry into the Competition is deemed acceptance of these terms and conditions.
- The officers, management and employees (or immediate family of an officer, manager or employee) of the Promoter, the agencies associated with this Competition and their related bodies corporate are not eligible to enter.
- Competition begins at 9.00am (AEST) on Thursday 15th July 2010 and closes at 11.59pm (AEST) on Sunday 15th August 2010 (the “Competition Period”).
- To enter the Competition and be eligible to win, entrants must: (a) complete the online entry form; (b) provide the Promoter with “their favourite business tip, hint or idea” (the “Competition Question”) by either one of the following methods:
- Create a video of no longer than three minutes and upload to YouTube.com.
- Create a slideshow of no longer than three minutes and upload to Slideshare.com.
- Create a photo album with captions and upload to Flickr.com.
- Write a post on their blog of no longer than 500 words.
- Submit a written entry of no longer than 500 words via the online entry form.
- All entries must include the entrant’s first name, last name and email address to be eligible for entry. Incomplete entries or those with defamatory, copyrighted, pre-used or offensive content will be ineligible. It is the entrant’s responsibility to inform the Promoter if their email address changes during the Competition Period.
- Only 1 entry per person will be permitted. The use of any automated software or any other mechanical or electronic means that permits the participant automatically to enter repeatedly is prohibited (“Repeat Entry Device”). If the Promoter reasonably believes that an entrant is using any Repeat Entry Device, the Promoter may disqualify that entrant without notice.
- There is 1 x Prize. The Prize consists of: 1 x Apple iPad valued at $629.
- The total maximum Prize pool value is $629. The Prize values are the recommended retail values as provided by the suppliers and are correct at the time of printing. The Promoter is neither responsible nor liable for any change in the value of the Prize occurring between publishing date and date the Prize is claimed. All Prize values are in Australian dollars.
- The Prizes are not transferable or redeemable for cash. The Prizes or any element of the Prizes cannot be exchanged for any other prize/s. The contents of the Prizes will be at the Promoter’s sole discretion. The Prizes are subject to availability and the terms and conditions of the entities supplying the Prizes.
10. Only one Prize per person will be awarded.
11. The Competition will be judged on the basis of creativity at Nett Publishing Pty Ltd of Level 4, 1-3 Smail Street, Broadway, NSW 2007 on Monday 16th August 2010 at 4.00pm (AEST). Chance plays no part in the selection of the Prize winner. The Prize winner will be notified via email on Tuesday 17th August 2010 and their name and winning entry to the Competition Question will be published on www.nett.com.au from Wednesday 18th August 2010. The Prizes must be claimed within 5 days of the publication of the Prize winner’s name.
12. If the Prize winner cannot be contacted or does not claim the Prize by the stipulated date, then the Prize will be forfeited and a substitute prize will not be offered in lieu of the Prize.
13. The entrant must be 18 years or over at the time of entry to enter the Competition.
14. All ancillary costs incurred in taking and using the Prize are the responsibility of the Prize winner. Unless expressly stated as being part of the Prize, all other expenses are the sole responsibility of the Prize winner.
15. The Prize winner is advised that tax implications may arise from their Prize winnings and they should seek independent financial advice prior to acceptance of their Prize.
16. It is a condition of accepting the Prize that the Prize winner may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.
17. All entrants agree to provide the Promoter or the Promoter’s authorised agent with proof of identity, residency, age and/or proof of entry validity if selected as the Prize winner or if reasonably requested by the Promoter or the Promoter’s authorised agent. Proof of age, identification, residency and entry considered suitable for verification is at the sole discretion of the Promoter. In the event that the Prize winner cannot provide suitable proof, the Prize winner will forfeit the Prize in whole and no substitute will be offered.
18. By entering the Competition, each entrant warrants that their entry is their own original work and that they own all rights, including copyright, in their entry. Each entrant indemnifies the Promoter in the event that this warranty is false.
19. No responsibility will be taken by the Promoter for any changes in dates, times or cancellations or other arrangements that may prevent the Prize winner from winning the Prize.
20. The Promoter reserves the right to cancel the award of prize/s to, and/or to disqualify any individual who, as determined in the sole discretion of the Promoter, has breached these terms and conditions or who has otherwise engaged in unlawful or improper conduct that is designed to jeopardise the fair conduct of the Competition.
21. The Promoter reserves the right, in its absolute discretion, at any time before the awarding of the Prizes to cancel the Competition or to vary or cancel the terms of the Competition or the award of the Prize including, without limitation, circumstances where in the Promoter’s opinion (which it shall form in its absolute discretion): (a) a Prize winner does not satisfy the Competition entry requirements; or (b) the Promoter cannot conduct the Competition or award the Prize for any reason beyond its control.
22. In the event that the Promoter cancels or varies the Competition or varies or withdraws the Prize it shall not: (a) be liable to any person for any loss or damage (including loss or damage caused by any negligence) arising out of, or in connection with, such cancellation, variation or withdrawal; and (b) be required to conduct the Competition at any other time.
23. No responsibility will be accepted by the Promoter for late, lost or misdirected entries and all entries are deemed to be received at the time of receipt of the entry into the Promoter’s database and NOT time of transmission by the entrant. The Promoter will accept no responsibility for any delays to entry caused by technical disruptions or malfunctions. The Promoter accepts no responsibility for outdated or incorrect contact details or contact details by which the entrant cannot be contacted during business hours on the relevant dates.
24. The Promoter accepts no responsibility for any Prizes that are damaged, delayed or lost in transit.
25. A decision of the Promoter in relation to the conduct of the Competition is binding and conclusive and no correspondence will be entered into.
26. Entrants enter the Competition at their sole risk. With the exception of liability which cannot be excluded by law, the Promoter shall not be liable for any loss or damage which is suffered (including but not limited to indirect or consequential loss) or for personal injury suffered or sustained as a result of taking the Prize or entering the Competition.
27. All entries become the property of the Promoter and may be communicated to the public by the Promoter or used for promotional purposes, subject to the Promoter’s privacy policy, which is available at www.nett.com.au. By entering the Competition, the Prize winner agrees to the use of their name, image, audio-visual recording and/or photograph/s, without compensation, and agrees that the Promoter will own copyright in any such images, audio-visual recordings and photograph/s. - No responsibility is accepted for lost, late or misdirected entries.
- The Promoter makes no representations or warranties as to the quality/suitability of any of the goods/services offered as prizes. To the extent permitted by law, the Promoter is not liable for any loss suffered or sustained, to person or property and including, but not limited to, consequential (including economic) loss by reason of any act or omission, deliberate or negligent, by the Promoter, or its agents, in connection with the arrangement for supply, or the supply, of any goods or services by any person to the prize winner. This clause does not affect, and is not intended to affect, any rights a consumer might have, which are not able to be excluded under applicable Australian consumer protection laws.
- You must be 18 years or over at the time of entry to enter any competitions in Nett magazine or on nett.com.au.
- In the event that any prize item is unavailable, the Promoter reserves the right to substitute a prize item of equal or greater value. The Promoter has absolute discretion as to whether it will provide such consent and need not provide any reasons to any person for providing or withholding consent.

Terms and conditions
- Entry is open to Australian residents, except employees and their immediate families of the Promoter and other agencies associated with the promotion.
- The prizes are as described and are not transferable or exchangeable, and cannot be taken as cash.
- This competition closes on the date detailed in the competition description.
- Winners will be notified by email within 21 days of promotion closing date.
- Competitions are games of skill unless noted with a corresponding State Permit, and chance plays no part in determining the winner. Each entry will be judged on individual merit. The judge’s decision is final and no correspondence will be entered into.
- All entries become the property of the Promoter, Nett Publishing. The Promoter reserves the right to use the content of winning and runners-up entries for the purpose of future promotions and may pass your details on to the prize vendor for the purpose of prize distribution.
